Terms of Use
Last updated: November 3, 2026
These Terms of Use ("Terms") govern your use of the Tervy app for iPhone and Apple Watch, its widgets and Shortcuts ("Tervy", "the app"), and the website tervy.app. Tervy is provided by Jiří Urbášek, an independent developer, Chářovská 60, 794 01 Krnov, Czech Republic ("we", "us"). By downloading or using Tervy you agree to these Terms. If you don't agree, please don't use the app.
Tervy is licensed to you through the Apple App Store. These Terms add to Apple's Licensed Application End User License Agreement (the "Apple EULA"). Where these Terms and the Apple EULA conflict, these Terms apply to the extent the Apple EULA allows.
1. What Tervy is, and what it isn't
Tervy is not a medical device and does not give medical advice. It doesn't diagnose, treat, cure or prevent any disease or condition. What it shows is information about your own records, not a health assessment. Always talk to a doctor or another qualified professional about your health, before starting or stopping any medication, supplement, diet or exercise, and before making changes related to alcohol use. Never ignore professional advice or delay seeking it because of something you saw in Tervy. In an emergency, call your local emergency number.
Tervy is a habit tracker. It lets you record changes you choose to make and shows, side by side, data that Apple Health already holds about you. On purpose, Tervy does not claim that any change caused any movement in your body data. Readings from wearables and phones can be inaccurate or missing, and Tervy's comparisons depend on them. Results such as "clearly lower" or "no clear difference" describe your recorded data only and may be wrong.
Some changes, such as stopping alcohol after heavy daily drinking, can be unsafe without medical supervision. If that might apply to you, ask a doctor before you start.
2. Who can use Tervy
You must be at least 16 years old, or the age of digital consent where you live if higher, to use Tervy. You need a compatible iPhone; the Apple Watch app needs a compatible Apple Watch. Current requirements are shown on the App Store. Body data features need data in Apple Health and your permission to read it.
3. Your license
Subject to these Terms and the Apple EULA, we grant you a personal, non-exclusive, non-transferable, revocable license to use Tervy on Apple devices you own or control, for your own non-commercial purposes. You may not copy, modify, reverse engineer, resell or redistribute the app, or use it in a way that breaks the law or harms others.
4. Free and Premium
Tervy can be used for free. Some features are available only with Tervy Premium, offered as an auto-renewable subscription (monthly or yearly) or as a one-time lifetime purchase. The features included, prices and any introductory offer are shown in the app before you buy, and may differ by country.
Subscriptions
- Payment is charged to your Apple ID account when you confirm the purchase.
- A subscription renews automatically for the same period at the then-current price unless you turn off auto-renew at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
- If an offer includes a free introductory period, you'll be charged when it ends unless you cancel at least 24 hours before. Any unused part of a free period is forfeited when you buy a subscription. Eligibility for introductory offers is decided by Apple.
- You can manage or cancel your subscription in your Apple ID account settings (Settings → your name → Subscriptions). Cancelling stops future renewals; you keep Premium until the end of the period you've paid for.
Lifetime purchase
A lifetime purchase is a one-time, non-consumable purchase that unlocks Premium for as long as the app is offered on the App Store for your devices. You can restore it on your devices with the same Apple ID using "Restore purchases" in the app.
Refunds
All purchases are processed by Apple. Refund requests are handled by Apple under its policies at reportaproblem.apple.com. Nothing in these Terms limits any refund or withdrawal right you have under the law of your country.
If Premium ends
If your subscription ends or is refunded, your data is not deleted and nothing you recorded is removed from export. Premium-only views are hidden again until you renew.
5. Your data
Your changes, answers, notes and Apple Health data are stored on your device, and you own them. You can export them or erase them at any time in the app. Because we don't store your records on a server, we cannot restore them if they're lost, for example if you delete the app without a device backup. Please keep backups of your device. How we handle personal data is described in our Privacy Policy.
6. Apple Health
Tervy reads Apple Health data only with your permission and, if you allow it, writes the drinks you log. Apple Health is provided by Apple, and we're not responsible for the accuracy or availability of data from Apple Health or from third-party devices and apps that write to it.
7. Changes to the app
We work to keep Tervy useful and reliable, and we may add, change or remove features over time. We'll try not to remove features you've paid for during a period you've paid for. Tervy may not be available or error-free at all times.
8. Intellectual property
Tervy, its name, icon, design, text and code belong to us or our licensors. These Terms don't give you any rights to them except the license in section 3. Apple, Apple Watch, iPhone and Apple Health are trademarks of Apple Inc.
9. Disclaimer
To the extent permitted by law, Tervy is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose, accuracy and non-infringement. We don't warrant that the app's information or comparisons are accurate, complete or suitable for any medical, health or other decision.
10. Limitation of liability
To the extent permitted by law, we're not liable for any indirect, incidental, special, consequential or punitive damages, or for loss of data, health outcomes or decisions you make based on the app. Our total liability for any claim relating to Tervy is limited to the amount you paid for Tervy in the 12 months before the claim. Nothing in these Terms excludes or limits liability that can't be excluded or limited by law, including for intent or gross negligence, or for death or personal injury caused by negligence, and nothing affects your statutory rights as a consumer.
11. Ending these Terms
You can stop using Tervy at any time by deleting it. We may suspend or end your license if you seriously break these Terms. Sections 1, 5, 8, 9, 10 and 13 continue to apply after these Terms end.
12. Changes to these Terms
We may update these Terms, for example when we add features or when the law changes. We'll post the new version here with a new date, and for significant changes we'll tell you in the app. If you keep using Tervy after a change takes effect, the updated Terms apply.
13. Governing law
These Terms are governed by the laws of the Czech Republic. If you're a consumer living in the European Union, you also keep the protection of the mandatory consumer laws of your country, and you can bring claims in the courts where you live. Consumers in the Czech Republic can also use out-of-court dispute resolution through the Czech Trade Inspection Authority (adr.coi.cz).
14. Apple
These Terms are between you and us, not Apple. Apple is not responsible for Tervy or its content, has no obligation to provide maintenance or support for it, and is not responsible for addressing any claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
